L’Amministrazione finanziaria sempre più spesso effettua accertamenti in materia di IVA nei confronti di società cessionarie definite “società-filtro” o “buffers” presupponendo che tali soggetti che abbiano intrattenuto rapporti con società definite “cartiere”, hanno partecipato ad una frode carosello finalizzata all’evasione delle imposte e realizzata mediante l’impiego di fatture per operazioni soggettivamene inesistenti.
Per tale ragione l’Agenzia delle Entrate rifiuta di concedere a tali soggetti la detraibilità dell’IVA relativa a tali operazioni. La fittizietà dell’operazione si desume dal fatto che i soggetti passivi sono diversi da quelli che realmente hanno posto in essere le operazioni imponibili. Per dimostrare il coinvolgimento del cessionario nella frode carosello sarebbe necessario accertare la consapevolezza della partecipazione di quest’ultimo ad un’attività illecita. L’Agenzia delle Entrate e il giudice tributario hanno una competenza e strumenti a disposizione limitati per verificare tale conoscenza del cessionario relativa alle altrui precedenti attività fraudolente.
La recente giurisprudenza della Corte di Cassazione, uniformandosi agli orientamenti della Corte di Giustizia UE, considera correttamente la consapevolezza, non come un stato soggettivo del contribuente, ma come una idoneità a conoscere l’illiceità delle operazioni poste in essere da altri soggetti sulla base degli strumenti (giuridici) disponibili nel sistema fiscale in cui opera.
Tax authorities frequently carry out VAT assessments towards transferees (i.e. companies which receive the goods) defined “filters” or “buffers”, considering that, having entertained commercial relationships with “missing traders” companies, they are part of a carousel fraud aimed at evading taxes and realised with fictitious invoices for non-existent companies. For these reasons, tax authorities deny traders involved in carousel frauds the right to deduct the input VAT. The fictitiousness of the operation shall be implied from the fact that taxpayers involved are different from those which effectively supply and receive the goods. In order to prove the involvement of the transferee in the carousel fraud, it is necessary to demonstrate its consciousness in participating in such unlawful operation. Tax authorities and tax courts have limited competence and instruments aimed at verifying transferee’s acknowledgement concerning previous fraudulent operations.
Recent case law of the Supreme Court, which aligns to CJEU’s decisions, correctly considers that such acknowledgement is not a subjective status of the taxpayer, but an objective capacity to know the unlawfulness of operations carried out by other companies exploiting legal instruments offered by the national tax system.
