L'accertamento sintetico è fondato sul tenore di vita del contribuente. Dopo le recenti novità legislative, esso muove sostanzialmente da due tipi di parametri: la spesa sostenuta dal contribuente per soddisfare le sue esigenze di vita e il c.d. redditometro. Nel primo caso, l’ufficio può recuperare a tassazione la differenza tra le spese sostenute nell’anno dal contribuente e il reddito dichiarato. Nel secondo caso, i contribuenti sono suddivisi in gruppi omogenei per luogo dove vivono e per composizione del nucleo familiare. Per ciascun gruppo omogeneo si tiene conto della spesa media annua calcolata dall’ISTAT. In questa ipotesi, l’amministrazione finanziaria può recuperare a tassazione, nel modo e con i limiti che si diranno nello scritto che segue, la differenza tra la spesa media ISTAT e il reddito dichiarato. In entrambi i casi (ovvero l’accertamento sintetico da spesa e l’accertamento sintetico da c.d. redditometro), l’accertamento è possibile se il reddito determinabile dall’amministrazione finanziaria eccede quello dichiarato di almeno un quinto.
La valutazione dell’amministrazione finanziaria ha natura di presunzione relativa, che ammette la prova contraria.
La disciplina dell’accertamento sintetico è stata di recente profondamente modificata. Nello scritto si prendono in esame le modificazioni più rilevanti e i loro effetti sul potere di accertamento.
The presumptive tax assessment (in Italian, accertamento sintetico) is one of the type of assessment that the tax authorities can use to verify the the income declared by the taxpayer. It is founded on the standard of living of the taxpayer. After the recent amendments to the its legal discipline, tax authorities has the power to estimate the revenue earned by the taxpayer and not declared by him through two different parameters: the expenses sustained by the taxpayer in the fiscal year and the so-called “redditometro”. According to the first criterion, tax authorities assess income on the basis of the difference between the amount of the expenses sustained by the taxpayer and the amount of the revenue returned by the same taxpayer. Using the second parameter, taxpayers are divided in homogeneous groups, on the basis of the place where they live and the composition and member of their families. For each group, ISTAT (Italian official statistic Institute) determines the average expenses of an ordinary family belonging to the group. Tax authorities can make reference to that average amount, taxing the difference between that amount and the income returned by the taxpayer.
In both the situations, the assessment is allowed only if the revenue determined by tax authorities exceeds the income returned by the taxpayer by one-fifth.
The income assessed by the tax authority has the nature of a rebuttable presumption, that permits to give the evidence of the contrary.
The legal discipline of this type of assessment has recently been deeply amended. The aim of this article is to describe the scope of these amendments and their effects.
