Con l'art. 93 del D.L. 24 gennaio 2012, n. 1, conv. nella L. 24 marzo 2012, n. 27, è stato modificato l’ultimo comma dell’art. 60 della disciplina dell’IVA (D.P.R. n. 633/1972) consentendosi al cedente, che sia stato destinatario di un avviso di accertamento o di rettifica, il diritto alla rivalsa “successiva” nei confronti del cessionario o committente.
Il lavoro affronta questo tema occupandosi preliminarmente del quadro normativo anteriore alla modifica di legge, individuando le ragioni del precedente divieto di rivalsa successiva nell’IVA, e ricostruendo le differenti posizioni della dottrina intervenuta sull’argomento. Successivamente, sono affrontate le ricadute che la nuova disciplina della rivalsa successiva avrà sul piano applicativo: dalla questione della possibilità di esercitare la rivalsa anche nel caso di accertamenti di tipo induttivo o basati su elementi presuntivi standardizzati, alla questione delle conseguenze che l’esercizio della rivalsa successiva potrà avere nel caso in cui l’accertamento, all’esito del giudizio, venga annullato dal giudice. L’argomento trattato fornisce poi l’occasione per tracciare il quadro generale dei tempi e delle modalità in cui è possibile l’emissione della fattura, o la sua integrazione, in un momento successivo a quello di effettuazione dell’operazione economica; e delle conseguenze che questa iniziativa determina sulla sfera del destinatario della fattura. A questo proposito viene differenziata la posizione del cessionario che ha diritto alla detrazione dell’IVA addebitatagli in rivalsa, rispetto a quella del cessionario che acquista in qualità di consumatore finale del bene e che in quanto tale non ha il diritto di detrarre l’imposta, con analisi degli strumenti di tutela di cui in tal caso egli potrà avvalersi nei confronti del cedente.
Art. 93 of Law Decree 24 January 2012, No. 1, converted by Law 24 March 2012, No. 27, modified the last paragraph of Art. 60 of the “VAT Act” (Presidential Decree No. 633/1972) allowing to the transferor, addressee of a notice of assessment, the right of a subsequent VAT refund towards the transferee.
The paper debates this issue, first of all dealing with the discipline before its modifications, identifying the reasons for the previous prohibition of the subsequent VAT charge and analysing the different positions of scholars on this specific issue. Then the research faces the effects of the application of the new discipline of subsequent charge: from the possibility to exercise the charge in case of tax assessments based on (standardized) presumptive elements, to the consequences that that the subsequent charge will have in case the tax assessment is annulled by the judge.
The topic treated also provides the opportunity to make an overview of the deadlines and cases where the invoice shall be issued, or integrated, after the transaction was made; and of the consequences that this innovation determines on the sphere of the invoice addressee. In this respect, it shall be distinguished the position of the transferee that has the right to deduct the VAT charged on him, from the one of the transferee who acquires a good as a final consumer and, as such, is not allowed to deduct VAT. In relation to this situation, the paper will analyse the various instruments of protection that the transferee may use against the transferor.
