L'ingresso della confisca “per equivalente” nei procedimenti penali per reati fiscali ha inevitabilmente originato una serie di criticità, tra cui, oltre agli ormai risolti dubbi in ordine all’applicazione retroattiva o meno dell’istituto, spiccano la sua sovrapposizione con altre modalità di recupero del tributo evaso ed altre misure afflittive, la difficoltà di individuazione e quantificazione del (prezzo o) profitto del reato, la sua applicazione nei confronti delle persone giuridiche e nei reati plurisoggettivi. Spesso le soluzioni offerte dalla giurisprudenza di legittimità non appaiono convincenti sotto il profilo dell’adeguato contemperamento tra l’obiettivo punitivo e al contempo ripristinatorio della confisca ed il rispetto dei fondamentali principi di equità, proporzionalità, colpevolezza e legalità. È auspicabile, allora, un’inversione di talune tendenze giurisdizionali efficientiste e repressive, al fine di riportare la lotta all’evasione fiscale sul terreno del rispetto delle garanzie. Invero, piuttosto che attuare irrazionali metamorfosi dello strumento della confisca al fine di soddisfare istanze di politica criminale, sarebbe necessario ripensare il sistema sanzionatorio tributario tenendo conto delle peculiarità della materia ed evitando irrazionali sovrapposizioni tra le reazioni amministrative e quelle penali.
The introduction of the confiscation “for an equivalent amount” in criminal proceedings for tax offenses has inevitably created many problematic issues: in addition to the now resolved doubts concerning its retroactive application, one can mention the overlapping of the new institution with different methods to recover the evaded taxes and other punitive measures, the difficult identification and quantification of the (price or) profit of the offense, the applicability of confiscation against legal entities and with regards to offenses involving more authors. The solutions proposed by the Italian Supreme Court are not often convincing from the point of view of the appropriate balancing between the punitive and the recovery functions of confiscation and the compliance of fundamental principles of equity, proportionality, legality and guiltiness. It is highly desirable, then, a reversal of some judicial repressive trends, in order to tackle tax evasion by enforcing, at the same time, the various guarantees provided. Indeed, rather than implementing an irrational metamorphosis of confiscation in order to meet the needs of criminal policy, it would be necessary to reform the whole system of tax offenses considering the particularity of tax law and avoiding the unfair overlap between administrative and criminal penalties.
